E-Verify Revises Employer Obligation

E-Verify®, a tool used by employers nationwide, plays a major role in the process of verifying employment eligibility. Recently, it was announced the system now requires enrolled employers to take action on tentative nonconfirmations (TNCs) within 10 federal working days. Effective Nov. 5, the system will send notices to employers that fail to comply.

TNCs occur when E-Verify identifies a mismatch between information provided by an employee and information contained in government records. The employer must then give the employee a chance to resolve the discrepancy. Completion of this process helps ensure employers get the most out of the system.

Crucially, failure to remain in compliance with the 10-day rule might result in the termination of an employer’s E-Verify account. For that reason, it pays to follow major changes in the system’s procedure.
