Managing compliance is a big job for HR in any industry. In hospitality, it can be especially challenging. Minimum wage, tax and tip credit requirements vary, depending on the state in which you’re located. Even employees working in the same location are paid differently and are subject to different laws based on the duties they perform. Tipped employees’ pay rates can change from week to week, depending on how busy business is…or isn’t.

Up until this point, small businesses – those with less than 50 full-time or full-time equivalent employees – were not faced with costly fines like their Applicable Large Employer (ALE) counterparts under the Affordable Care Act (ACA). But that’s no longer the case, according to a tax imposed under Internal Revenue Code Section 4980D.

Under the Free Labor Standards Act (FLSA), many salaried employees with managerial jobs who receive more than $450 a week aren’t entitled to overtime pay, but that would change under a new proposal by the Obama administration.
